General Conditions

• You must be an adult (18+ years, some countries 21+ years) or have permission from your legal guardian who is an adult, to access and view content on this website.
• You understand and agree that some content might only be suitable for adults.
• You understand and agree that all of the content and services on this website are provided on an “as-is” basis, without any warranty of any kind and our liability to you in connection with your use of this Service is very limited. The content on this site does not claim to be 100% correct/perfect or guarantee success. The final decision to follow any advice or suggestions, and the use of any downloaded content, is solely up to you.
• You understand and agree that if any fraudulent and/or malicious activity is detected then legal intervention may be called upon to facilitate a resolution. In some extreme cases, there may be an investigation performed by the authorities.

Membership

Membership is an optional service which comes with additional features and content. Add-on options will only be available for purchase to active members.

If you decide to become a member:

• You understand and agree that creating an account with false information is a violation of our terms, including accounts registered on behalf of others or persons under the age of 18.
• Your account cannot be transferred to others, this means that only the original account holder is entitled to view/use member-only content/services.
• You must be of legal age to make financial decisions and have the authority to do so.
• You understand and agree that your account may be suspended or terminated if any misconduct is detected, including without limitation if you breach the Terms.
• You understand and agree that Membership and Add-on purchases are subject to a no refund policy, this means that refunds will not be issued.

Costs and Price Changes

A great amount of time and effort goes into web development, creating website content, in addition there are hosting and domain fees, software fees, electricity bills, extra time for research, updates and improvements.

We reserve the right to change the Membership fee and/or Add-on fees without notice.

Refunds

Due to the nature of our online Service, refunds will not be granted.

Membership Fee

A one-off fee is charged to assist with the above-mentioned costs of running this website and to validate the user’s intent of being a legitimate member.

Add-on Fees

The add-on fees are used to assist with the above-mentioned costs of running this website and to grant members access to additional content, features and/or licenses.

Compliance with Data Security

By being a member, you must implement and maintain reasonable measures to prevent unauthorised persons from accessing and using your account. This includes reasonable steps to protect your password or access. You are solely responsible if you leave your device unattended, access your account on a public device or use a non-secure network. The term “Device” means a computer, tablet, phone or other electronic devices which may be used to access our Service.

Account Cancellation

We reserve the right to suspend or terminate your account without notice if you do not adhere to our Terms.

Copyright and Ownership

All of the assets and content available on this website remain the property of SL and will only be offered to view and download on this website. If you discover someone fraudulently using and/or reselling something from this website then please report the issue by contacting us. [Contact]

We may feature sponsored content on our website. This content may be subject to different copyright and ownership conditions depending if the content was supplied by the client or created by us for the client.

Licenses and Conditions

Minor Change: Modifying colours and/or fonts (does not constitute a major change).
Major Change: Making modifications that result in the assets not being easily recognisable.

What You Cannot Do

• You cannot claim ownership of assets, ideas and/or concepts. This means that you must let others know that you have obtained the content from this website.
• You cannot resell assets, ideas and/or concepts (e.g. 3D Printable Models, Printable Paper Crafts, Graphics, etc).
• You cannot use assets as logos for commercial purposes.
• You cannot use assets as the main element for printing on merchandising (e.g. shirt, mug, posters, etc) or commercial goods (e.g. bedding, furniture, wall paper, etc).
• If the End Product contains our assets or is created using our concepts that are clearly distinguishable then it cannot be mass produced for the sole purpose of being sold.
• You cannot use assets for commercial advertising on televisions, online marketing or in-app marketing.

Personal Use License (‘PUL’)

By being a member, you as the account holder are granted a PUL and have the right to use the assets for personal and/or non-commercial projects that do not bring any monetary gain. This means that you cannot use the assets for any business, company, non-profit or organisation of any kind.

e.g. You can use assets to assist with your child’s school work, apply for a job position using a resume template or print assets to decorate your home.

You can also use the assets as part of your personal projects.

e.g. Using a texture, image and/or pattern as a background on your blog.

e.g. Using an icon to complement the main layout on your website.

Commercial Use License (‘CUL’)

By being a member with an active “Pro” add-on, you as the account holder are granted a CUL and have the right to use the assets for your personal sole trader business and/or commercial projects. You are also entitled to basic assistance with opening and using assets.

Charging Clients

You cannot charge your clients for the original assets. You can however charge your clients for the time you spend making changes and/or modifications, time taken for exporting and emailing final artwork, printing, delivery, meetings and discussions.

Expired License

If your “Pro” add-on expires then you cannot continue using the assets for future projects. Existing uses of the assets while being a paid member are covered under the CUL. Also see “Client/Designer Sub License” and “ECUL” for additional information.

Some assets can continue to be used for your personal sole trader business after the CUL expires. You can continue using the business card templates, other collateral templates and assets you used on your website.

Client/Designer Sub License

Your client or designer should be made aware that they are only allowed to use the assets for the End Product and for the single purpose it was intended for. You should also let them know that you are using assets from our website and conditions apply.

If you are a member who is a designer:

e.g. If you use our assets on a client’s website, the client can use those assets on other pages of that website but cannot reuse the assets on another website or for printing on collateral.

e.g. If you use assets to create print collateral for a client, the client can continue to use the print collateral but cannot modify or make variations without you being involved.

If you are a member who is a client:

e.g. If you task a designer to create a website for you and you supply them our assets to use as part of the layout, that designer cannot continue using those assets for any other projects apart from what you have hired them to create.

Extended Commercial Use License (‘ECUL’) [Currently Not Offered]

This is required for using assets, concepts and/or other content for mass production, large-scale commercial use and/or commercial advertising. The ECUL will usually be a contract-based license which will be discussed and must be agreed upon by all parties involved.

e.g. Using assets for marketing on the web, television or apps.

e.g. Using assets for creating commercial products like bedding, furniture, wall paper, etc.

e.g. Using assets or concepts to create commercial digital products like games and apps.

e.g. Using concepts to create physical products which will be used for commercial purposes.

Special/Non-commercial Use

In some cases, you may be granted permission if you officially submit a request.

e.g. Using assets on your YouTube or Vimeo channel may be granted (some conditions may apply like adding a description and a link).

Links to Other Websites

Our Service may contain links to third-party web sites or services that are not owned or controlled by us.

Our Service has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Changes

We reserve the right, at our sole discretion, to modify or replace this TOS at any time. We will try to provide at least 14 days’ notice prior to any new terms or revisions taking effect. We may specify the date it was changed and may also send out an email to inform members of our TOS update.
